Kota Kinabalu: A jobless undocumented man was jailed seven months by the Magistrate’s Court, here, Monday, for assaulting a man two months ago.

Timhar Anuar, 33, pleaded guilty before Magistrate Marilyn Kelvin to voluntarily causing hurt to Koh Yan Kok on June 22, at 12.30am at the parking lots in Lintas Square.

Timhar was jointly charged with another accused M. Halim M. Julkipli in committing the offence under Section 323 of the Penal Code along with two accomplices still at large.

Halim pleaded not guilty to the charge, which carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.

One of the men, later identified as Timhar, hit the complainant on the head. The girlfriend then got out of the car trying to stop the assault.

Another man, later identified as M. Halim, snatched the girlfriend’s handbag from the passenger seat.

Timhar was arrested on July 17, said the prosecution.

Timhar, who was not represented, requested a lenient sentence as he is unemployed.

DPP Atiqah applied an appropriate sentence from the date of conviction as a deterrent to Timhar and any would-be offenders to prevent similar offences.

She submitted that it was a random crime against a stranger with no particular reason and that the complainant was injured due to the attack.

Marilyn ordered Timhar to serve the sentence from Monday and to be referred to the Immigration Department thereafter.

Halim was offered bail at RM1,800 in two sureties pending pre-trial case management on Sept 9.

In another case, a 24-year-old woman was fined RM1,800 or a month’s jail for having gambling paraphernalia.

Nur Azwa Anuar admitted to having two illegal 4D slips and RM30 cash on June 14, at 11am in a premises at Inanam town.

Nur was arrested during a raid by police after being monitored engaging in gambling activity and the paraphernalia was seized from her, the court heard from the prosecution.

She was charged under Section 9(1) of the same Act which provides for a fine of up to RM5,000 or up to six months jail or both, on conviction.

Duty counsel Lim Ming Zoong, representing Azwa, requested a lower fine as she is unemployed and married with one child.

The court ordered the seized money to be forfeited as government revenue.
