Jobless man charged with five counts of cheating and theft

Kota Kinabalu: An unemployed man was charged in the Magistrate’s Court here with various counts of cheating and theft, including stealing two luxury watches worth RM67,000.

Tan Kok Kwang @ Vincent Brian Tan, 45, pleaded not guilty before Magistrate Stephanie Sherron Abbie to committing the offences between May 16 and June 16, this year.

Earlier, the court was informed by the prosecution that the psychiatric report of the accused had been obtained, which stated that Tan is fit to plead and stand trial.

Tan was previously referred to Hospital Mesra for mental observation.

Read more On the first count, Tan was accused of cheating Nolin Marauh of a gold pendant and a necklace by showing her a fake receipt at 11.30am, on May 16 at Kedai Emas Wawasan Goldsmith, Wawasan Plaza here.

Tan on the second count, allegedly stole a Franck Muller watch worth RM28,000 belonging to Tay Teck Chin at 10.45am on May 19 at the Piano Lounge Grandis Hotel, here.

On the third count, Tan allegedly stole a Rolex watch worth RM39,000 belonging to Teo Bee Khee at 4.30pm on May 21 at ON23 Sky Bar Hyatt Centric here.

Tan on the fourth count, was accused of cheating Wan Zaharah Zulhasim over a rental deposit for a house that did not belong to him in Taman Impian, Inanam, which caused Wan to transfer RM3,500 into his bank account between 11.28am and 11.32am on June 8.

On the fifth count, Tan allegedly stole three queen-size mattress and a bed, two air-conditionings, two water heaters, bedside table, refrigerator, sofa set, television cabinet, cupboard, two coffee tables, gas stove, iron board, dishes, pans and spoons and a plastic chair belonging to Rowenna Romedius at 10.20am on June 16 in a house at Taman Impian, Jalan Kg Nountun, here.

The first and fourth count were framed under Section 420 of the Penal Code, which carries a jail term of between one year and 10 years and with whipping and liability to a fine, on conviction while the second and third counts were under Section 379 of the Penal Code which provides for a jail term of up to seven years or fine or both, on conviction.

The fifth count was under Section 380 of the same Code which carries a jail term of up to 10 years and liability of a fine or whipping, on conviction.

The prosecution proposed bail at RM5,000 while counsel Nelson Angang applied for a lower bail amount.

The court released Tan on a bail of RM2,000 in two sureties on each count and set Sept 19 for case management on the second and third count while the first, fourth and fifth count were fixed for case management on Sept 25.

In another case, a water purifier agent claimed trial to having a stolen item.

Md Fadzrull Imam, 29, was accused of keeping a stolen wallet belonging to Malak Rugalson at 7pm on Sept 1 at Kg Lembising, Putatan.

The charge is framed under Section 411 of the Penal Code.

Stephanie set Sept 19 for pre-trial case management and allowed the accused bail at RM1,500 in two sureties.
