The case classification has been upgraded from Section 44(1)(a) of the Road Transport Act 1987 for driving under the influence causing injury, to Section 44(1)(b) for driving under the influence of alcohol above the prescribed limit resulting in death.

“If convicted, the penalty ranges from 10 to 15 years imprisonment and a fine of not less than RM50,000 and not exceeding RM100,000,” he said.

The accident happened at about 9.10pm when Darna was jogging with friends from Bandar Sri Indah at Mile 10, Jalan Apas toward the T2 area at Mile 2.

A 57-year-old male driver, suspected of being intoxicated, first collided with a multi-purpose vehicle driven by a 39-year-old man who was traveling from Taman Ria 11 to Tawau Airport.

The collision caused the four-wheel-drive vehicle to veer out of control onto the left shoulder of the road, where it crashed into Darna and her jogging companions.

She sustained severe injuries and was immediately rushed to the Tawau Hospital for emergency treatment.
