Kota Kinabalu: A labourer who brought his underage girlfriend to a motel and raped her twice, besides committing sexual assault against her, was jailed a total of 32 years and ordered to receive six strokes of the cane.
Sessions Court Judge Monica Linsua imposed the sentences on Mohd Ashriff Haikal Samlli, 24, after he pleaded guilty to all four charges on Tuesday.
He was sentenced to nine years’ jail and two strokes of the cane for raping the 15-year-seven-month-old girl in a motel room in Sipitang on Jan 23, followed by 10 years’ jail and two strokes for raping her again in another room at the same motel on March 24.
For the third and fourth charges, Mohd Ashriff was sentenced to six years’ jail and one stroke of the cane for physically sexually assaulting the victim on Jan 23, and seven years’ jail and one stroke for sexually assaulting her on March 24.
However, the court ordered all the sentences to run concurrently from his arrest on March 26, meaning he will serve 10 years in jail and receive six strokes of the cane, while Section 376(1) of the Penal Code provides for up to 20 years’ imprisonment and whipping upon conviction for rape.
