Man, 62, fined for possessing stolen watch

Kota Kinabalu: A 62-year-old man was fined RM3,800 or jailed for eight months by the Magistrate’s Court, here, Friday for possessing another man’s Luminox watch.

Muhamad Rafiq Saman Abdullah pleaded guilty before Magistrate Marilyn Kelvin to retaining stolen property, namely a silver-coloured Luminox watch belonging to Chin Lam Thin, on Feb 20 last year at his house in Taman Prestij, Jalan Tuaran, at around 3:56pm.

The charge is framed under Section 411 of the Penal code which carries a punishment of imprisonment for a term of not less than six months and not more than five years, and is also liable to a fine, on conviction.

The court heard from Deputy Public Prosecutor Muhammad Yousof Tahir Mahmood that Chin discovered a stranger had broken into his house and noticed several of his belongings were missing.

A suspect was detained following a report and seizure in Luyang during an investigation led by Inspector Hamidi on a similar case on March 12 last year.

The seizure uncovered a silver-coloured Luminox watch strap belonging to Chin.

Rafiq Saman was later arrested at the Kepayan Central Lockup compound on March 28, last year for his involvement in the case.

Unrepresented in court, Rafiq Saman pleaded for leniency. However, Deputy Public Prosecutor Yousof Tahir sought a deterrent sentence.

The court ordered the Luminox watch to be returned to its rightful owner.
