Man fined for causing death by negligence

Kota Kinabalu: A 38-year-old man was fined RM5,000 or 12 months’ jail in default for negligently causing the death of another man.

Zazlieandy Zainuddin maintained his guilty plea before Sessions Court Judge Hurman Hussain during the facts and sentencing hearing on Friday.

Zazlieandy had previously admitted to the amended charge of causing the death of Rahmat Abdullah by negligence at Putatan between 4.30am and 5.20am on July 27, 2023.

The offence, under Section 304A of the Penal Code, carries a jail term of up to two years, or a fine, or both, upon conviction.

In mitigation, defence counsels Korventt Wheezer E. Jomiji and Safrin Saleh asked for leniency, highlighting that Zazlieandy was a first-time offender who deeply regretted his actions.

They also informed the court that he has a wife and two children, one of whom is an OKU card holder, and that he fully cooperated with the police during the investigation.

Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir urged the court to impose a stern sentence to serve as a lesson to Zazlieandy and deter potential offenders.

He emphasised the seriousness of the offence, noting that Zazlieandy had taken the life of a husband, father and son.

The court also ordered the bail to be refunded.
