Man jailed for assaulting wife, having stolen items

Kota Kinabalu: A 30-year-old deliveryman was jailed a total of 15 months on Thursday on two counts of assaulting his wife and having stolen items.

Nasri Isnin pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to committing the offences.

Nasri was jailed 10 months for voluntarily causing hurt to his 34-year-old wife by kicking her abdomen and punching her arm and head as well as biting her left arm at 1am on March 13, this year in a company quarters in Sepanggar.

He was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.

On the second count, Nasri was handed another five months jail for having stolen items comprising a bag, laptop, sunglasses and a watch belonging to Md Nurhan Aniq at 7.30pm on Oct 15, this year in a workers’ room at Jalan Kolombong, Inanam.

The charge is framed under Section 411 of the Penal Code, which carries a jail term of up to five years or fine or both, on conviction.

Nasri was ordered to serve the jail sentence consecutively.

On Nasri’s first case, the prosecution informed the court that a heated argument between the couple led to the assault after Nasri accused his wife of having an affair with his older brother.

The wife suspected that Nasri was high on drugs, said the prosecution.

In Nasri’s second case, the court heard that the said items were reported missing from the complainant’s room on Oct 15.

Nasri was arrested by police on the same day following a report lodged by the complainant.

Duty counsel Lim Ming Zoong, representing Nasri, requested a lenient sentence as he was the sole breadwinner of his family, while the prosecution applied for an adequate sentence.

Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.

Meanwhile, Nasri is also facing another charge of taking drugs but no plea was taken from him pending the chemist’s report.

His case was fixed for mention on Dec 6.

In the same court, a 38-year-old trader was charged with dishonest concealment of RM2,100 belonging to a man in her CIMB Bank account.

Jaimah Jamali claimed trial to dishonestly concealing the money belonging to Gilbert Chester at 7.13pm on July 28, this year at Kg Lapasan Telipok.

She was charged under Section 424 of the Penal Code.

The court set Dec 1 for case management and offered the accused bail at RM2,000 in two sureties.

Earlier, the prosecution proposed bail at RM5,000 in two sureties, while duty counsel Lim requested a lower bail amount.
