Kota Kinabalu: A divorced mother of three was sent jailed for 10 months on Thursday for stealing a trolley containing several 20kg rice packets from a convenience store, last month.

Two others pleaded not guilty.

Sylviona Vallencie, 31, pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to stealing a trolley of Sazarice Cap Roda rice belonging to Servay Express Sdn Bhd, Api-Api Centre at 8pm on Oct 23, this year.

Sylviona committed the offence along with an accomplice still at large.

Inspector Albert Basiri prosecuting, informed the court that eyewitnesses confirmed that Sylviona put the rice from a trolley into a Perodua Axia outside the premises.

Duty counsel Carmen Khoo, representing, Sylviona applied for a lenient sentence because Sylviona was remorseful.

Khoo added that Sylviona was a divorcee with three children aged three, five and six respectively and also financially supporting her 15-year-old autistic sister.

Albert in applying for an adequate sentence informed the court that the rice was never recovered.

Sylviona was charged under Section 380 of the Penal Code which carries a jail term of up to 10 years and liability of a fine on conviction.

Meanwhile, the store’s shop assistant was also charged with stealing a trolley of Sazarice Cap Anggur rice at the same place and time.

Rosdei Rosman, 36, claimed trial for committing the offence under Section 381 of the Penal Code which carries a jail term of up to seven years and liability of a fine on conviction.

The court set Dec 13 for case management and offered Rosdei bail at RM3,000 in two sureties.

The prosecution earlier offered bail at RM5,000 in two sureties.

Duty counsel Lim Ming Zoong, representing Rosdei, applied for a lower bail as he was unemployed.

In the same court, another man was charged with two counts of abetting Rosdei and Sylviona in the crime, respectively.

Fabian Julian pleaded not guilty to both charges framed under Section 109 of the Penal Code.

He was released on a bail of RM3,000 in two sureties on each charge pending case management on Dec 1 and Dec 13, respectively.

Earlier, Albert proposed bail at RM5,000 but duty counsel Lim Zoong, representing Fabian requested a lower bail amount because Fabian is currently unemployed after he was fired from his job.
