Kota Kinabalu: A 42-year-old vehicle painter charged with the murder of a 25-year-old man in Inanam early this year, will have his case rementioned on Oct 17.
Magistrate Jessica Ombou Kakayun set the date for Jan Esa during mention of his case on Wednesday. The prosecution informed the court that they are still waiting for the post-mortem report.
Jan, an IMM13 holder, is accused of murdering Chung Zi Qian between 1.24pm and 5pm on Feb 22, in a bush area facing the Kota Kinabalu San Ching Taoism Association Temple. No plea was taken from him when he was first charged on March 9.
The charge under Section 302 of the Penal Code carries the death penalty, on conviction. Jan, who was not represented, was ordered to be remanded further as the charge against him has no provision for bail.
In another case, an unemployed man charged with assaulting his 72-year-old father, will also have his case rementioned on Oct 17. Jessica fixed the date for Nicholos Joseph Green for an instruction from the Deputy Public Prosecutor’s office when the complainant informed the court of his wish to withdraw the case.
Nicholos allegedly caused hurt to Joseph Green at 9.45pm on Nov 22, 2021 in a house at Kg Imbahan, Ketiau, Putatan. The charge under Section 323 of the Penal Code carries a jail term of up to a year or fine of up to RM2,000 or both, on conviction.
Joseph told the court that he wanted to withdraw the case voluntarily as Nicholos has repented and that he had retracted his previous report against his son.
In another case, four men were penalised for committing drug-related offences.
Three of them Hanafie Patrick, Hisam Tiar and Ak Md Azrin Ak Matkassim pleaded guilty to taking syabu at separate locations here.
Hanafie was sentenced to six months’ jail while Hisam and Azrin were fined RM2,000 or six months each. Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail, on conviction
The other man Azmi Abdullah was fined RM3,500 or 12 months jail for having 0.30gm of syabu. The charge under Section 12 (2) of the Dangerous Drug Act 1952 provides for a fine of up to RM100,000 or up to five years jail or both on conviction.
