Kota Kinabalu: An entertainment outlet owner was on Tuesday fined RM3,000 or jailed six months by the Magistrate’s Court, here, for operating his premises beyond the permitted hours.
Lionil Peter, 29, pleaded guilty before Magistrate Marilyn Kelvin to operating the Spark Bar in Inanam beyond its permitted operating hours, at 3.03am on Aug 22.
The charge was framed under Section 3 of the Public Entertainment Ordinance 1958 and punishable under Section 11 of the same Ordinance, which provides for a fine of up to RM50,000 or a jail term of up to one year, or both, on conviction.
The court heard from the prosecution that Lionil, as the owner of the premises, was found operating the entertainment business beyond the stipulated hours.
Counsel Lim Ming Zoong, representing Lionil, requested a lenient fine, while the prosecution applied for a deterrent sentence.
In another case, a 20-year-old man was fined RM2,000 or jailed two months for having unlicensed public lottery slips.
Jacky Phan pleaded guilty to having four pieces of paper containing numbers and letters, which were records of an unlicensed public lottery at a premises in Plaza Kivatu, Penampang, at 3pm on Aug 18.
The charge was framed under Section 9(1) of the Common Gaming Houses Act 1953, which carries a fine of up to RM5,000 or a jail term of up to six months, or both, on conviction.
The prosecution informed the court that police arrested Phan, who was suspected of acting as an agent for an unlicensed public lottery operation, at the premises.
Police also seized a handphone, RM45 in cash, a mobile printer and four printed sheets containing numbers.
Investigations found that Phan was having the four unlicensed public lottery slips.
Inspectors Yusdi Basri and Dzulfamie Amrin prosecuted.
