Kota Kinabalu: A 57-year-old government servant was freed from two charges of raping an underage girl.

The two charges against Ag Salleh Kurus had been withdrawn before Sessions Court Judge Elsie Primus, when the prosecution informed that the representation letter had been accepted.

The court was informed that the prosecution had received instruction from Senior Federal Counsel, to have both charges against Ag Salleh withdrawn.

The court ordered the bail to be refunded to Ag Salleh.

Read more On the first count, Ag Salleh was accused of raping the 14-year and nine-month-old girl at 6pm in early May 2021 inside a car parked by the seaside in Kuala Penyu town.

On the second count, he allegedly raped the same girl at 7pm on May 14, 2021 inside a room at Kuala Penyu town.

He was charged under Section 376(2)(d) of the Penal Code carries a jail between 10 and 30 years, and whipping, on conviction.

Deputy Public Prosecutor Mas Izzaty Lokman appeared for the prosecution while counsel Rakhbir Singh defended Ag Salleh.
