Kota Kinabalu: A Malaysian Volunteer Corps (Rela) personnel was charged with raping his stepdaughter.
The 57-year-old man pleaded guilty before Sessions Court Judge Zaini Fishir, to the charge against him.
However, his sentencing was deferred to Nov 2 this year and also for the facts of the case to be read.
The man is accused of raping the 15-year and eight-month-old girl at a house in Sipitang on Sept 23 this year.
He was charged under Section 376(1) of the Penal Code which carries a jail term of up to 20 years, and whipping, on conviction.
Due to their relationship, the man will face additional punishment under Section 16 of the Sexual Offences Against Children Act 2017, which provides for a jail term of up to five years and to be whipped at least two strokes, if convicted.
Pending the disposal of his case, the man was further remanded following an objection by the prosecution.
Earlier during the proceedings, Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir applied for a new mention date for facts and sentencing as the prosecution needed to prepare documents pertaining to the case.
He also requested for no bail to be granted to the man on the grounds that the alleged victim is the man’s stepdaughter and that there was a high risk he would tamper with the prosecution’s witnesses especially the girl.
The man, who was not represented, had nothing to say.
