Stealing handphone: Man gets 30 months

Kota Kinabalu: An unemployed man was sentenced to 30 months’ jail by the Magistrate’s Court here for stealing a handphone last month.

Juraman Rudi, 26, pleaded guilty before Magistrate Jessica Ombou Kakayun to stealing a Vivo Y51 handphone belonging to the QC Factory Concept (QCC Baked) at 7.17am on July 12 at the QC Factory Concept premises on the ground floor of the Centre Point Complex here.

The charge under Section 380 of the Penal Code carries a jail term of up to 10 years and fine on conviction.

Earlier, the court was informed by the prosecution that Juraman was caught red-handed by the security guard while rummaging through the drawers in the shop.

The said handphone was later found in Juraman’s possessions, said the prosecution, adding that he was then handed to police.

Unrepresented, Juraman requested leniency by saying that had to steal and that he was remorseful of his wrongdoing.

Inspector Albert Basiri prosecuting applied a deterrent sentence on the grounds that the crime was not accepted by the community and could lead to other criminal acts.

Meanwhile, a 22-year-old man was jailed three months for engaging in an online gambling activity for the second time.

Rimar admitted to committing the offence with a handphone at 8.05pm on Jan 2, at the five-foot-way in front of premises at Taman Suria in Penampang.

Inspector Albert Basiri, prosecuting, told the court that Rimar was arrested by police following information and that RM100 cash was also seized from him.

Unrepresented, Rimar requested leniency and confessed that it was his second time committing the similar offence and that he was fined on his first case previously.

He was charged under Section 7(2) of the Common Gaming House Act which provides for a fine of up to RM5,000 or up to six months jail or both on conviction.

The court ordered the seized money to be forfeited by the government.
