Perikatan Nasional is seeking a stay of implementation following its deregistration by the Registrar of Societies pending a High Court hearing, says Takiyuddin Hassan.
KUALA LUMPUR: Perikatan Nasional (PN) is seeking a stay of the implementation of its deregistration by the Registrar of Societies (RoS), including all its consequences, pending a Kuala Lumpur High Court hearing on a related matter this Thursday.
PN secretary-general Datuk Seri Takiyuddin Hassan said the coalition would also challenge the validity of the deregistration order through legal channels.
“PN urges the Attorney General to explain this action and clarify his department’s position in court during the hearing of PN’s application for a stay (of an earlier suspension notice) on Oct 22,” he told a press conference at the Parliament building here today.
Takiyuddin said RoS’ decision to deregister PN raised questions, as the High Court had previously granted leave for a judicial review application and scheduled a hearing on PN’s application for a stay of the suspension notice for Oct 22.
He said that on Oct 13, the court had set the hearing after the Attorney-General’s Chambers (AGC) stressed the need for inter partes proceedings, meaning the parties involved must be present.
The Kota Bharu MP said PN had also submitted a written application on Oct 14 requesting that no further action be taken pending the court hearing, but the request had gone unanswered.
“Meanwhile, the AGC’s submission on Oct 19 stated that the deregistration process was ‘still ongoing’, without informing us that the action would be implemented the following day (today),” he said.
In a statement this morning, RoS announced PN’s deregistration after finding that the explanation submitted by the coalition had failed to rebut the grounds for deregistration outlined in an earlier notice.
The department said the decision was made by the Registrar of Societies after reviewing all documents and explanations submitted by PN on Oct 12.
According to RoS, the reasons provided by PN also failed to offer sufficient justification for maintaining the coalition’s registration.
