Theft: Man is jailed, fined

Kota Kinabalu: An unemployed man was jailed 10 months and fined RM2,000 or another two months, Friday, for theft.

Abdul Latip Umar, 38, pleaded guilty before Magistrate Stephanie Sherron Abbie to stealing two units of solar fan, 20 units of hand fan, four units of computer speaker and three units of table fan belonging to Johnny Wong in front of the Valknow Tech Sdn Bhd at Asia City Complex at 11.40am on Sept 5.

The court was informed by the prosecution that prior to the incident, the complainant realised that a box containing electrical equipment he placed in front of his premises had gone missing.

The complainant went out to check and saw two men not far away from the premises and asked them about the box in which one of them claimed that he had purchased the item but failed to produce a receipt, the court heard.

A check from the premises’ CCTV recording found that the man stealing the box with its content worth RM800.

Duty counsel Michelle Usman, representing Latip, requested him to be placed on a good behaviour bond.

However, Inspector Albert Basiri prosecuting, informed the court that Latip has four previous conviction records and was not suitable to be placed on bond.

Latip was charged under Section 380 of the Penal Code carries a jail term of up to 10 years and could also be fined and for the second or subsequent offence should be punished with imprisonment and fine or whipping.

In another case, a 24-year-old man was fined RM1,000 or a month’s jail for having gambling paraphernalia.

Syamrin Suharto admitted to having five illegal lottery tickets at 5pm on Dec 12, last year at Donggongon town, Penampang.

He was charged under Section 9(1) of the Common Gaming House Act, which carries a jail term of up to six months, or fine of up to RM3,000, or both, on conviction.

Meanwhile, a cake seller was charged with molesting a woman.

Abd Zaidi Abd Rahmad, 37, pleaded not guilty to committing the offence to a 19-year-old woman at 6pm on June 7 this year at Jalan Tun Fuad Stephen.

The charge under Section 354 of the Penal Code provides for a jail term of up to 10 years, or with fine or with whipping or with any two of such punishments, on conviction.

Counsel Lim Ming Zoong @ Lawrence applied for a lower bail on the grounds that he was on police bail and needed to report to the police station once a month and has no flight risk.

The Magistrate set Oct 12 for pre-trial case management and released Zaidi on a bail of RM2,500 in one surety.
