
Kota Kinabalu: Three men were jailed between eight and 10 months by the Magistrates’ Court here after pleading guilty to separate charges of having stolen property.
Mohammad Salleh, 36, Md Syukri Izzuddin, 33, and Rajesh Awot, 43, each admitted before Magistrate Marilyn Kelvin to the offences, which fall under Section 411 of the Penal Code.
Mohammad was jailed 10 months for dishonestly retaining a stolen motorcycle, namely a grey Yamaha 135LC belonging to Md Al Hashemi Hasbullah at the Penampang police headquarters compound at 12.15pm on July 7.
The prosecution informed the court that the motorcycle had been reported stolen on May 25 this year while parked at Queen Elizabeth Hospital 1.
CCTV footage from the hospital showed two individuals pushing the machine along the main road at around 9pm.
Md Syukri, meanwhile, received a nine-month jail term for having another stolen Yamaha 135LC motorcycle belonging to Mohd Rizal Tahir.
He was caught with the vehicle at 6.30pm on Aug 21, near the staircase of Block D, PPR Taman Kinarut Ria, Papar.
The court was told that the motorcycle had been reported missing on Aug 13, in Putatan.
Rajesh was jailed eight months for retaining two stolen Hilux rear lamps, belonging to Mohd Shahzilin Basirin at 3.30pm on Dec 20, 2024 at Taman Fajar, Manggatal.
The prosecution said the lamps had been reported stolen on Dec 19, 2024.
Mohammad, Syukri and Rajesh requested a lenient sentence while the prosecution applied for a deterent sentence.
The court ordered the trio to serve their respective sentences from the date of their arrest. The charge against the trio carries a jail term of between six months and five years and liable to a fine, on conviction.
Meanwhile, Mohammad was handed another eight months’ jail for taking syabu.
Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.
