Two illegals jailed for cutting cables of China firms

Kota Kinabalu: Two undocumented men were jailed five months each by the Magistrate Court, Monday, for committing mischief by cutting cables.

Mamaer Ali, 23, and Sibal Zain, 42, pleaded guilty separately before Magistrate Lovely Natasha Charles to committing the offence.

Mamaer pleaded guilty to cutting cables belonging to Kibing Solar at its construction site in KKIP at 6.16pm on Jan 16 while Sibal admitted to cutting cables belonging to China Railway Construction Group at 7.40pm on Jan 16 at the construction site of Coral Bay, Sutera Harbour.

Mamaer and Sibal were charged under Section 431A of the Penal Code which carries a jail term of up to two years or fine or both, on conviction.

Read more According to Inspector Kelvan Elson Maik, a worker at Kibing Solar spotted a man engaging in suspicious act and swiftly called the police.

Upon the police’s arrival, they saw Mamaer cutting the electric cable and was arrested.

In Sibal’s case, Kelvan informed the court that a security guard saw Sibal attempting to cut the cables. The guard with the help of a friend apprehended Sibal and subsequently handed over to the police.

Both Mamaer and Sibal requested for a lenient sentence while Kelvan applied for a deterrence sentence.

The court ordered both of them to be referred to the Immigration Department after serving their sentences.

In another case, a 38-year-old man was charged with burglary.

Jemar Aman, 38, pleaded not guilty to breaking into a house that is used as a storage place belonging to Hazwina Amir Rahman at Jesselton View Condominium, Luyang between 4am and 5.30am on Sept 9, 2022.

The charge is framed under Section 457 of the Penal Code.

Duty counsel Lim Ming Zhoong, representing Jemar, applied for a lower bail sum as he is the sole breadwinner of four children and works at a hardware store.

The court fixed March3 for pre-trial case management and released the accused on bail of RM1,800 in two sureties.
