
Kota Kinabalu: A restaurant waitress was jailed six months and fined RM1,000, in default 14 days’ jail, for attempting to cheat a man over the sale of a fake gold ring last month.
Sessions Court Judge Amir Shah Amir Hassan handed down the sentence on Binah Warajid, 45, after she pleaded guilty to the charge.
The court heard that Binah had attempted to deceive the man by making him believe that she wanted to sell a gold ring at a goldsmith shop in a hypermall here on Aug 4 this year.
The offence under Section 420 of the Penal Code, read together with Section 511 of the same Code, carries a jail term of up to 10 years and whipping, as well as a fine upon conviction.
Section 511 provides for up to half of the punishment prescribed under Section 420.
The court heard that Binah went to the premises to sell the purported gold ring.
However, after the ring was tested, it was found to be fake.
Further checks on the shop’s WhatsApp group found that Binah had been flagged in June for two similar attempts at goldsmith shops in Keningau and the city.
She had previously been warned not to repeat the offence. However, a police report was lodged following the latest incident.
The court ordered Binah, who also had no valid documents, to be referred to the Immigration Department after completing her jail sentence for deportation.
Deputy Public Prosecutor Nurul Shafeerah Mad Iskim appeared for the prosecution, while Binah was unrepresented.
