On 21 Oct 2026, Shuhaily pleaded not guilty at the Sepang Magistrate's Court to two charges of voluntarily causing hurt under Section 323 of the Penal Code.

The charges stem from a September 28, 2026, incident at KLIA Terminal 1.

Prior to assuming the role as the Director General of MCBA, he held office from July 2021 to May 2023 as the Penang Police Chief and from May 2023 to August 2023 he was the Kuala Lumpur Police Chief and from August 2023 to June 2025 the Bukit Aman CID Director.

Compare to many other cases when allegations of violence or assault (investigated under Section 323 or similar provisions of the Penal Code) involve law enforcement officers, the public often flags a noticeable pattern of delays or cases being classified as No Further Action (NFA) by the Attorney General’s Chambers (AGC).

If standard legal protocol were followed, the reports lodged by the 2 policemen should be still subject to review and investigation.

In the case of the Director General of Malaysian Checkpoints and Borders Agency (MCBA), the case was referred to the courts in less than a month from the date of the incident?

There appears to be an insidious, coordinated and collected effort to remove him unceremoniously or derail the operations of MCBA using the incident at KLIA as the trigger point.

The idea of establishing a Single Border Agency (SBA) was first formally initiated during a Cabinet meeting on November 16, 2018, the time when PH was occupying Putrajaya, which formed a dedicated Cabinet Committee to study the merger.

On July 30, 2021, the concept was finalized, and an official Single Border Agency (SBA) Nucleus Team was created on Oct 11, 2021, to handle the structural groundwork.

In Jan 2024 the Cabinet officially approved the establishment policies for the agency.

In mid-2024, facing intense congestion at airport immigration counters and rising cross-border smuggling, PMX instructed personnel to begin coordinating duties immediately.

This sudden deployment under existing agency authority, ahead of the legislative framework, gave the public impression that it appeared out of nowhere.

Late 2024–2025 (Formal Legality), the formal Malaysia Border Control and Protection Agency Act 2024 (Act 860) was passed and gazetted.

The agency gradually integrated over 20 scattered checkpoints under one unified command structure.

its creation has triggered an aggressive, high-stakes internal war against embedded syndicates.

Prior to the MCBA, border enforcement was fractured across six separate entities, including the Malaysian Immigration Department and the Royal Malaysian Customs Department.

Well-organised smuggling syndicates frequently exploited these inter-agency communication gaps and lack of accountability to coordinate illegal entry.

By merging these functions under a singular, unified command, the MCBA removed the independent silos that corrupt officers relied on to operate.

In the agency's first full year of operations, it terminated the services of multiple officers, placed dozens under active investigation for integrity breaches, and saw nearly 30 personnel arrested for corruption.

To truly neutralise corrupt elements, the MCBA recognized that it could not simply borrow staff from legacy departments permanently.

The agency introduced a dedicated, independent MCBA Service Scheme.

This scheme allows the agency to recruit its own personnel from scratch, bypass the embedded cultures of older agencies, and instill a strict paramilitary "chain of command" focused heavily on compliance and rigorous asset/lifestyle tracking.

Does the public still wondered why is there a concerted effort to remove Dato Sri Shuhaily?

Or to stifle or blunt the effectiveness and efficacy of MCBA in the long run?
