Kota Kinabalu: A 34-year-old private van driver charged with sexually abusing a 14-year-old boy, will know his fate on May 28 this year.

Sessions Court Judge Elsie Primus set the date for Agoes Han Suin after the defence closed its case on Tuesday.

Agoes is accused of committing the offence by inserting his finger into the boy’s anus at 7.30am on Dec 16, 2017 in a house in Kota Belud.

He was charged under Section 14(a) of the Sexual Offences Against Children Act 2017 which provides for a jail term of up to 20 years, and whipping, on conviction.

On Dec 9, 2020, Agoes was ordered to enter his defence after the court found that the prosecution had proved a prima facie case against him.

Deputy Public Prosecutor Mas Izzaty Lokman conducted the prosecution while counsel Al Hafidz Lokman defended Agoes.

Agoes is currently released on court bail.
