Kota Kinabalu: A man was sentenced to 10 months’ jail for committing mischief by burning electricity cables.
Magistrate Lovely Natasha Charles handed the sentence to Alvin Abu Bakar who pleaded guilty to the charge against him on Thursday.
Alvin committed the offence at 2.30pm on Nov 24, 2021 at the CH 34.200 near the old site of SK Pekan Telipok, near here.
The offence under Section 431A/34 of the Penal Code carries a jail term of up to two years, or with fine, or both, on conviction.
The court ordered Alvin to serve the jail sentence from the date of his arrest and referred to the Immigration Department after completing his jail time.
Meanwhile, the court set Feb 2 for mention for Alvin’s accomplice Azmin Isah who claimed trial.
During mitigation, Alvin who was not represented, asked for leniency and that the sentence to be run from the date of his arrest.
However, Inspector Kelvan Elson Maik urged the court to impose an appropriate sentence on Alvin.
The court heard that when the complainant of the case arrived at the site, he saw smoke from the bushes at the site area.
Upon checking the cause of the smoke, the complainant then saw Alvin and his accomplice were burning the electricity cables.
The complainant who was the contractor to install electricity cables at the area, then detained Alvin and his accomplices for committing mischief before handing them to the police.
