Kota Kinabalu: A 31-year-old woman who assaulted another woman with high heels at a club house here last year was on Monday fined RM2,000 or two months’ jail.

Flevia Bettar pleaded guilty before Magistrate Wan Farrah Fariza Wan Ghazali to voluntarily causing hurt to one Siti Norafatin Samlee, 34, on Jan 14, 2024, at 1.10am, at The Cruise Tanjung Aru.

The prosecution informed the court that prior to the incident, the complainant, who was accompanied by three friends, was in the clubhouse and had spoken to a customer at the next table after noticing the said customer playing a game.

Read more While the complainant was preparing to leave the premises, the customer, without the complainant’s knowledge, threw a glass at her, which was blocked.

At the same time, the customer’s friend, named Flevia, struck the complainant with a high heel.

AdvertisementAs a result, the complainant sustained injuries to her nose and head.

Flevia was arrested on Jan 30 the same year, and investigations revealed that she had committed an offence under Section 323 of the Penal Code for voluntarily causing harm to the complainant.

AdvertisementCounsel Rizwandean Bukhary M Borhan, representing Flevia, requested for a fine, noting that Flevia was unemployed, had no previous convictions, and had expressed remorse for her actions.

Deputy Public Prosecutor (DPP) Muhammad Haikal Hazwan Md Yatin applied an appropriate sentence.

In another case, a 43-year-old businessman was charged with cheating a man with RM227,700.

Sam Yau Fui, who appeared before Magistrate Dzul Elmy Yunus, pleaded not guilty to cheating one Yap Hai Yong by inducing him to rent five units of premises at KK Times Square and causing the complainant to transfer RM227,700 to him.

The offence allegedly committed between Sept 15, 2023 and Oct 11, 2023 at KK Times Square here.

The charge is framed under Section 420 of the Penal Code.

DPP Bryan Francis in applying for another mention date, proposed bail at RM10,000 in two sureties.

Counsel Chin Tek Ming representing Sam applied a lower bail amount and informed the court that all alleged sum had been paid on Jan 28 this year and confirmed that the defence would be writing a representation letter to the DPP’s office.

The court fixed March 28 for mention and released the accused on a bail of RM5,000 in one surety.
