
Kota Kinabalu: A 31-year-old telecommunications contractor was charged in the Sessions Court here Friday with causing grievous hurt to his wife.
Md Shafie Abdul Karim pleaded not guilty before Sessions Court Judge Monica Linsua to causing grievous hurt to his 34-year-old wife at a rented house in Talang Taun, Putatan, Penampang, at 12.10pm on June 21.
The charge under Section 325 of the Penal Code, read together with Section 326A of the Penal Code, carries a jail term of up to seven years and a fine.
Section 326A provides for the maximum imprisonment to be doubled where the offence is committed against a spouse.
Deputy Public Prosecutor Fazriel Fardiansyah applied for a pre-trial case management date and objected to bail on the grounds that although the offence is a bailable one, the circumstances of the case warranted stricter consideration.
He submitted that there was a high risk of interference with prosecution witnesses if the accused were released on bail, as the complainant is the accused’s own wife and the alleged assault occurred within the domestic setting.
Unrepresented, the accused requested bail, telling the court that he was working to support his family.
The court fixed July 31 for pre-trial case management and ordered the accused to be further remanded.
