
Kota Kinabalu: The Magistrate’s Court here Tuesday sentenced a 32-year-old man to nine months in jail for having a stolen audio mixing equipment.
E-hailling driver Mohd Idzllan Allan pleaded guilty before Magistrate Marilyn Kelvin to keeping a stolen sound mixer unit belonging to Nexus Karambunai, on March 5, this year, at 8.06pm, at Block N6 Nexus Karambunai, Manggatal.
The charge under Section 411 of the Penal Code carries a jail term of up to five years or fine or both, on conviction.
The facts of the case presented by the prosecution, stated that the said audio equipment had gone missing from the hotel ballroom earlier that same day.
Idzllan, who was then arrested, led the police to an abandoned workers’ quarters, where the item was recovered.
Counsel Lim Ming Zoong @ Lawrence, representing Idzllan, requested a lenient sentence on the ground that Idzllan could not afford a fine.
Lim also informed the court that Idzllan, who is married with two children, works as a freelance e-hailing driver and is the sole breadwinner for his family.
In another case, a 39-year-old man was fined RM25 or jailed five days for threatening a man with the intention of causing him harm, last year.
Anthonius Leo pleaded guilty to committing the offence against one Mohd Syahrul Shahmeer on Sept 30, 2024, at 12.30pm, outside the Lagenda Bumimas KKIP building.
The charge under Section 8(1)(e) of the Minor Offences Ordinance provides for a RM25.
The facts of the case presented by the prosecution stated that police investigations revealed that Anthonius had approached the complainant prior to the incident and accused him of being the reason he had lost his job.
Meanwhile, another man was also ordered to pay a fine of RM25 or five days’ jail for causing distress by acting in a threatening manner with intention of disturbing a man’s peace.
Rodden Lo admitted to committing the offence against one Pilatus Andreas on May 28, 2024, at 10.44pm, at the Sigah roundabout in Penampang.
Based on the facts of the case, presented by the prosecution, Lo had exited his vehicle, holding a screwdriver, and pointed it at the complainant while shouting abusive words.
This followed an incident in which the complainant honked his car at Lo’s vehicle, urging him to drive more carefully.
Lo was also charged under Section Section 8(1)(e) of the Minor Offences Ordinance.
Inspector Yusdi Basri prosecuted.
