
Kota Kinabalu: A 38-year-old man who used fake payment receipt to pay for his food amounting to RM2,700, was jailed 18 months.
Magistrate Stephanie Sherron Abbie meted out the sentence to Abraham Anthony Daim who pleaded guilty, Monday.
Abraham had used Maybank payment receipt on Sept 4, 2022 at the Funky Farm Food Court in Jalan Cyber Perdana, near here.
The offence under Section 471 of the Penal Code and punishable under Section 465 of the same Code which provides for a jail term of up to 20 years, or fine, or both, on conviction.
The court ordered Abraham to serve the jail sentence from the date of his arrest on Sept 30, 2022.
During mitigation, counsel Lawrence Lim applied for leniency and the sentence to be from date of his arrest.
However, Prosecuting officer Inspector Suzie Kupit urged the court to impose an appropriate sentence.
The court heard that Abraham had eaten at the complainant’s stall repeatedly and made payments by online money transfer to a CIMB account under the name Rocket Enterprise belonging to the complainant.
Abraham submitted the transaction receipt via WhatsApp and on Sept 20, 2022, the complainant checked the company’s account and found that there was no money transferred into the account as per the receipt submitted by Abraham.
The complainant rechecked all the payment receipts amounting to RM2,700 and found that it was fake.
The complainant lodged a police report as she suspected that Abraham cheated her by forging the payment receipts made through online transactions.
