Fisherman charged with assaulting, threatening his wife

Kota Kinabalu: A 40-year-old fisherman was charged in the Magistrate’s Court, here, Friday, with two counts of assaulting his wife and threatening to injure her.

Yandy Boy Wahab, an IMM13 holder, who appeared before Magistrate Stephanie Sherron Abbie, pleaded not guilty to the charge.

On the first count, Yandy was accused of voluntarily causing hurt to his 31-year-old wife on April 11, this year, at 11.45pm, in a house at Kg Lok Urai, Pulau Gaya.

On the second count, he was alleged to criminally intimidating his wife, also at the same place and time.

Read more The first count is framed under Section 323 of the Penal Code read together with Section 326A of the same Code.

Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.

The second count, under Section 506 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.

The court fixed May 17 for pre-trial case management and ordered Yandy to be remanded further.

In another case, two security guards claimed trial to abetting their accomplices, who are still at large, in committing mischief on copper cables (earth wire).

Md Affendy Ibrahim, 26, and Safarie Sabile, 31, allegedly committed the crime on April 9, this year, at 4.45am, on the 26th floor of the Elemen Utara KK Condominium, in Manggatal, along with two accomplices.

The charge under Section 109 of the Penal Code read with Section 431A of the same Code, carries a jail term of up to two years or fine or both, on conviction.

The duo were released on a bail of RM2,000 in two sureties each pending ptcm date on June 10.
