
Kota Kinabalu: A 32-year-old was jailed a total of 25 months on Monday on two counts of splashing red paint at two women’s houses here.
On the first count, Hafez Andary was jailed 12 months after he pleaded guilty before Magistrate Stephanie Sherron Abbie to committing mischief by doing splashing the paint on the house wall and car belonging to a woman, causing RM61 losses at 11.35pm on Feb 7, this year at Taman Cerah, Manggatal.
Hafez was handed 13 months’ jail by Magistrate Lovely Natasha Charles to committing similar offence to another woman’s house wall and car at 7.30pm on Feb 10 this year at Kepayan low-cost house.
Hafez was ordered to serve the jail sentence from the date of his arrest on Feb 14.
The prosecution in the first case informed the court that Hafez was found to have committed the offence and that his fingerprints were extracted from the scene.
Hafez also left a threatening note in front of the complainant’s house, the court heard.
On the second count, the court was told by the prosecution that the complainant lodged a report after she found that her house was splashed with red paint and suspected it was done by an illegal money lender’s runner.
Police Investigations revealed that the fingerprints extracted from the scene belonged to Hafez, who also left a threatening note in front of the complainant’s house and put an iron chain on the fence of the complainant’s house.
The courts also heard from the prosecution that the complainants had borrowed money from the illegal money lenders and failed to pay their respective loans by claiming that they were cheated and that the interest was too high.
The complainants lodged a police report for fear of their safety.
Each charge against Hafez framed under Section 427 of the Penal Code provides for a jail term of between one year and five years and fine, or both, if convicted.
Meanwhile, a 39-year-old labourer charged with cheating a woman of RM3,000 over a water meter application will go on trial on June 13 this year.
Harbi Bakri was accused of cheating one Normah Usop into believing that he could manage the application for a water meter and its installation at her rented house in Sipitang.
The offence was allegedly committed on Sept 28, 2021 at Kg Ketiau Putatan.
The charge is framed under Section 420 of the Penal Code.
Harni, who was not represented, was released on an extended bail pending the trial.
