Jailed for also assaulting another brother

Kota Kinabalu: A 40-year-old man, currently serving 12 months’ jail for assaulting his younger brother, was on Thursday sentenced to 12 months’ jail for committing a similar offence on another brother last year.

Unemployed Sabdali Nahul pleaded guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to one Shamree Nahul, 29, at 10.10pm on Dec 10, 2022.

The court was informed by the prosecution that prior to the incident, Sabdali had asked for money from Shamree to buy cigarettes and other items.

Sabdali was infuriated when he got “no” for an answer and threatened to beat up Shamree, who then sought help from their younger brother.

A scuffle ensued between them where Sabdali took a swing at Shamree.

The charge, under Section 323 of the Penal Code, carries a jail term of up to one year or fine on conviction.

The court ordered Sabdali to serve the sentence from the date of his arrest.

On Jan 18, Sabdali was jailed 12 months by another Magistrate after he pleaded guilty to causing hurt to their younger brother for not being given money to buy Maggi at the same place and time.

Meanwhile, a 37-year-old trader was charged with assaulting his younger brother.

Roland Longpin pleaded not guilty to voluntarily causing hurt to one Rayner Longpin, 34, at 3pm on Jan 18, this year at a Sinalau Bakas stall, Jalan Sulaman, Telipok.

The prosecution proposed bail at RM3,000 while Roland, who was not represented, requested for lower bail.

The court set Feb 23 for case management and released Roland on a bail of RM1,000 in two sureties.
