KTV’s costly late night

Kota Kinabalu: An entertainment outlet manager was fined RM4,000 or jailed seven months by the Magistrate’s Court on Thursday, here, for operating his premises beyond the permitted hours.

Ismail Lamat, 44, pleaded guilty before Magistrate Marilyn Kelvin to operating New Deluxe KTV in Asia City beyond its permitted operating hours, at around 2.30am on Aug 26, this year.

He was charged under Section 3 of the Public Entertainment Ordinance 1958 and punishable under Section 11 of the same Ordinance, which provides for a fine of up to RM50,000 or a jail term of up to one year, or both, on conviction.

Prosecuting officer Yusdi Basri told the court that the police heard music playing loudly from the premise. Investigations found that there were four customers at the time, and the accused, as manager and receptionist of the premise, was detained.

Ismail, who was unrepresented, pleaded for a lenient sentence during mitigation, as he had five children. Two of which were still young and three who were already schooling.

However, the prosecution applied for a deterrent sentence.
