Kota Kinabalu: A 59-year-old man was fined RM2,000 or seven months’ jail by the Magistrate’s Court here on Friday for assaulting a motorist following a road accident.
Stanley Peter pleaded guilty before Magistrate Marilyn Kelvin to voluntarily causing hurt to one Tang Yung Bin at 9.20pm, on May 5, near an auto parts shop in Penampang.
He was charged under Section 323 of the Penal Code, which provides for imprisonment of up to one year or a fine of up to RM2,000, or both, on conviction.
The court heard from the prosecution that a collision occurred between the complainant’s Proton Saga and Stanley’s Proton Wira at the location.
The accident resulted in a misunderstanding between the two men, which escalated into an argument.
Initial investigations found that the complainant was driving from Kota Kinabalu towards the Kampung Hungab roundabout in Penampang when his vehicle was hit from behind by a vehicle driven by Stanley.
Shortly afterwards, Stanley got out of his vehicle, walked towards the complainant’s vehicle and punched the right side of the complainant’s head once with his right hand, causing him pain.
Although Stanley denied involvement, a witness had seen him punching the complainant’s head, the court heard.
Police investigations then found that Stanley was involved in the offence.
The unrepresented Stanley requested a lenient sentence, saying he had repented and was the sole breadwinner for his family.
The prosecution applied for a deterrent sentence.
In another case, a 22-year-old entertainment outlet caretaker was fined RM3,500 or eight months’ jail for operating the premises beyond the permitted hours.
Krinardy Rojil pleaded guilty to committing the offence at 1.30am on May 5, this year, at Galaxy Club & KTV Room, at Koidupan Township, Penampang.
He was charged under Section 3 of the Public Entertainment Ordinance, punishable under Section 11 of the same law, which provides for a fine of up to RM50,000 or imprisonment of up to one year, or both, on conviction.
The prosecution informed the court that police team went to the premises on the said day.
Upon arrival, the complainant found that loud music was still being played inside the premises.
He then identified himself as a senior police officer and showed his police authority card to the premises caretaker, later identified as Krinardy, over the premises operating beyond the permitted hours.
Krinardy, who was unrepresented, applied a lower fine, saying he did not work at the premises.
The prosecution applied for a deterrent sentence.
