Man gets jail for disposing stolen motorcycle

Kota Kinabalu: A 22-year-old man was jailed 10 months by the Magistrate’s Court, here, for helping to dispose of a stolen motorcycle.

Hiew Wen Jian admitted before Magistrate Dzul Elmy Yunus to assisting in disposing of a Yamaha Y15ZR belonging to Siti Zakiah Juan Datu at a workshop in Kg Panaitan, Jalan Taiwan, Kota Marudu, at 3.30pm on Aug 13.

Hiew faced the charge together with two brothers, Bexter Donny, 19, and Dexter Donny, 21, who denied the allegation.

They were jointly charged under Section 414 of the Penal Code, read with Section 34, which provides for six months to five years’ jail, or a fine, or both, on conviction.

The court fixed Nov 24 for pre-trial case management and released the duo on RM2,000 bail each with two sureties, subject to reporting monthly to the investigating officers.

For Hiew, the prosecution said Siti Zakiah learnt from her younger brother at 4.30pm on the same day that her Yamaha motorcycle, which he had been using, had gone missing and was believed stolen.

She lodged a police report, with her loss estimated at RM8,000.

Five days later, a police team from Penampang CID arrested Hiew at the Papar District Police Headquarters compound.

Unrepresented, he pleaded for leniency.

The court ordered his sentence to run from the date of arrest.

In a separate case, a 30-year-old man claimed trial to two counts of cheating involving the sale of Perodua Axia cars.

Raz-di Mohd Salam pleaded not guilty before Magistrate Wan Farrah Farriza Wan Ghazali to both charges under Section 420 of the Penal Code, which carries one to 10 years’ jail, whipping and a possible fine.

On the first charge, Raz-di allegedly cheated Faiz Nazrin Shah on Aug 16, 2024, at Perodua Alamesra, here, by claiming he could secure a Perodua Axia 1.0 G (Auto) and inducing Faiz to part with RM22,200.

On the second charge, he allegedly repeated the deceit on Aug 19, 2024, at the National Registration Department, Federal Government Complex, here, causing Faiz to hand over another RM20,000.

The court set Dec 1 for case management and released Raz-di on RM5,000 bail.
