
Kota Kinabalu: A pharmacist was fined RM5,000, or four months’ jail for failing to ensure that the retail sale of poisons was carried out under her supervision.
Michelle Chong pleaded guilty before Sessions Court Judge Elsie Primus to the charge against her.
Chong, as a licensed pharmacist under the Poisons Act 1952, committed the offence at noon on Feb 14, 2024 at the Pharmex Sdn Bhd 11, in Jalan Hj Yaakub, Kg Air, here.
The offence under Section 16(3) of the Poison Act and under this Act, stated that mandates that the sale of poison must be personally supervised by the registered pharmacist or licensed person.
Meanwhile, a worker of the same pharmacy was fined RM3,000 or two months jail for selling one strip of Hovasc 10mg by retail and the item was containing Amlodipine poison.
The Amlodipine is a Group B poison listed under the First Schedule of the Poisons Act 1952.
Chong Khyun Mui admitted to the charge against her and was found selling the item by retail to a man without a prescription from a registered medical practitioner at the same place and time as Chong.
Prosecuting Officer Fashihatul Affandi from the Pharmacy Department appeared for the prosecution.
