
Kota Kinabalu: A 35-year-old vendor was sentenced to three days’ and fined RM2,000, or two months’ jail by the Magistrate’s Court here for threatening a City Hall enforcement personnel.
Jamil, who holds a Temporary Resident Identification Card, pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to criminally intimidating one Albert Dickolas, while he was issuing a parking summons in Segama on Sept 25, at 4pm.
Deputy Public Prosecutor Arfa Anchal Khan informed the court that the incident began when a City Hall enforcement personnel found a vehicle, parked in a lot under the Segama overhead pedestrian bridge, without a recorded payment through the Sabah Smart Parking system.
When the personnel attempted to issue a summons, Jamil became aggressive, pulled out a wooden stick from his van and threatened to assault him, saying: “If you summon me, I’ll hit you right here.”Members of the public nearby intervened to defuse the situation.
Jamil was then arrested by police, the court heard.
He was convicted under Section 506 of the Penal Code, which carries up to seven years’ jail, or a fine, or both.
In another case, a 43-year-old man was jailed 12 weeks for stealing three cans of beer from a convenience storeMajilik Kuanang admitted before Magistrate Dzul Elmy Yunus to stealing the Carlsberg Special Brew worth RM89.70 at the 99 Speedmart, 88 Marketplace, on July 29, at 11am.
He was charged under Section 380 of the Penal Code which carries a jail term of up to 10 years or fine on conviction.
The court heard from the prosecution that Majilik entered the outlet and placed 13 cans of the beer into a reusable bag before walking out without paying.
He was arrested on Aug 1 at 3.40pm to assist in police investigations.
By then, the court was told, he had already consumed all the stolen beer.
CCTV footage and an identification parade confirmed him as the person seen leaving the store with the drinks.
A stock check by staff also showed 13 cans missing.
Unrepresented, Majilik requested a lenient sentence, adding that he had been detained for two months and five days.
Prosecuting officer Inspector Alia Nuurlysa Adnan applied a deterrent sentence.
The court ordered Majilik to serve the sentence from the date of his arrest.
