
Kota Kinabalu: The Magistrate’s Court, Monday, fined a man RM2,000 or eight months jail for having 199ml of nicotine which was listed under the first schedule of the Poisons Act 1952.
Jordan Acthilles, 19, pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at 12.05am on Oct 12, 2023 behind a convenience store at Plaza 333, Penampang.
The offence was framed under Section 9(1) of the Poisons Act 1952 and punishable under Section 32(2) of the same Act which provides for a fine of up to RM50,000 or five years jail or both, on conviction.
Deputy Public Prosecutor Muhammad Al-Hakim Abdul Razak informed the court that Jordan, who was detained by police, surrendered a bag containing a plastic with liquids suspected to be drugs.

Unrepresented, Jordan requested a lenient sentence as he is married and his wife is eight months pregnant and he has only been on a job for two months.
Jordan also informed the court that he was earlier fined RM2,000 by another magistrate for a drug case.
The prosecution applied a maximum punishment to be imposed.
Meanwhile, 15 people, including Jordan, were penalised for committing drug-related offences.
Thirteen of them admitted before Magistrate Stephanie Sherron Abbie to taking amphetamine and syabu while the rest pleaded guilty to having syabu.
The 13 were Jordan, Ling Mee Sing, Jefry Mawal, Md Alfiansyah Said, Theodore Ryan, Edixtor Gebril, Jison Dondongn, Peter Chin, Meiko Louis, Muliadi Jasli, Azizan Inal, Md Fadzil Yusuf and Md Fazil Husen, who committed the offence at separate locations here and Penampang between Sept 19 and Oct 24, last year.
Jordan and Jison were each fined RM2,000 or eight months jail, Ling and Jefry were sentenced to 18 months jail, while Alfiansyah, Theodore and Edixtor were handed 12 months jail.
Peter, Meiko, Muliadi and Azizan were jailed 10 months each, while Fadzil and Fazil received eight months each.
Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.
Meanwhile, Julius Majit was sentenced to 11 months jail after he admitted before Magistrate Stephanie to having 0.13gm of syabu at 12.30pm on Oct 12, 2023 at Inanam town.
Another man, Al Ryan Larry Johnny, 26, was jailed nine months after he pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to having syabu weighing 0.02gm on June 17, 2023, at 9pm, in a house, at Penampang.
Unrepresented, Al Ryan requested leniency and asked for his sentence to run concurrently with the sentence of 12 months jail he currently served for taking syabu.
Deputy Public Prosecutor (DPP) Ling Ghuong Zin applied for an adequate sentence on Al Ryan.
Both Julius and Al Ryan were charged under Section 12(2) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM100,000 or up to five years’ jail, or both, on conviction.
