Kota Kinabalu: A 29-year-old man was jailed two months by the Magistrate’s Court here Tuesday for helping to dispose of a stolen bass guitar.
Mohd Affendi Johinny pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to committing the offence at a roadside in Lorong Lengkok 2, Kampung Likas, at about 7pm on Aug 3.
He was charged under Section 414 of the Penal Code, which provides for imprisonment of up to seven years, or a fine, or both, on conviction.
The court heard that the complainant lodged a police report after his employer’s shop at Lot 3, Likas Stadium, was broken into and several items were reported stolen.
Affendi was subsequently arrested and admitted his involvement during questioning.
He then led police to the location where the stolen guitar had been kept, resulting in its recovery.
The complainant’s employer later identified the guitar as one of the items stolen from the shop.
The court ordered Affendi to serve the sentence from the date of his arrest.
In a separate case, a man was fined RM1,500, or jailed one month for gambling in a public place.
Yushurry Justin pleaded guilty to committing the offence on the pavement outside a cafe at Kepayan Ridge Commercial Centre at about 3.15pm on July 26.
He was charged under Section 7(2) of the Common Gaming Houses Act 1953, which carries a fine of up to RM5,000, or imprisonment of up to six months, or both, upon conviction.
The prosecution told the court that police conducting Op Dadu, targeting online reload gambling, went to the location following information about illegal gambling activities.
Police found Yushurry sitting on the pavement with a mobile phone.
A check of the phone found an application called “ePay Mobile Reload” using the username “Kepayan-Yusang”, with a remaining credit balance of RM2,152.
Police seized the items and arrested Yushurry for allegedly being involved in online reload gambling.
