Police Probe DAP's Tony Pua Over Najib's Pardon Critique as Royal Decree Sparks Controversy

The police are currently investigating statements made by Tony Pua of the Democratic Action Party (DAP) regarding the recent decision by the Pardons Board to reduce the sentence of former Prime Minister Datuk Seri Najib Razak. Inspector-General of Police (IGP) Tan Sri Razarudin Husain announced the investigation and specified that Pua is under scrutiny for potential violations of Section 4(1) of the Sedition Act 1948 and Section 233 of the Communications and Multimedia Act 1998.

In an official statement, Razarudin mentioned that Tony Pua is scheduled to provide his statement tomorrow. The questioning will be conducted by the Classified Crime Investigation Unit, Prosecution/Legal Division (D5), Criminal Investigation Department, Bukit Aman.

Razarudin justified the investigation by highlighting that Pua's comments on Facebook are perceived as an attempt to incite public disdain towards the royal institution. This, despite the decision being within the prerogative of the Agong, as outlined in Article 42 of the Federal Constitution.

Initially sentenced to 12 years in prison and fined RM210 million for charges related to abuse of power, breach of trust, and money laundering linked to RM42 million from SRC International, a former subsidiary of 1Malaysia Development Bhd, Najib's sentence was halved by the recent decision of the Pardons Board.

According to the official statement from the Federal Territories Pardons Board, the decision was reached during a meeting on January 29. Chaired by then Yang di-Pertuan Agong Al-Sultan Abdullah Ri’ayatuddin Al-Mustafa Billah Shah, the meeting considered five pardon applications, including the one from Najib.

The Federal Constitution dictates that the Agong presides over the Pardons Board meetings for the Federal Territories, which comprises the attorney general, the Federal Territories minister, and a maximum of three other members appointed by the Agong. The statement from Razarudin emphasized the importance of respecting the constitutional process and refraining from actions that may undermine public perception of the royal institution.
