Unregistered products: Man fined RM5,000

Kota Kinabalu: A 37-year-old man was fined a total of RM5,000 for selling products containing poisons without licence, unregistered products and cosmetics without labels.

Ivan Sudampam George Mokunjil pleaded guilty before Sessions Court Judge Azreena Aziz, to the three charges against him, on Monday.

On the first count, Ivan was fined RM1,000 or a week behind bars for having 15 products containing poison listed in the First Schedule of the Poisons Act 1952. He has no licence for having the poison.

He committed the offence at 12.25pm on March 24, 2021 at the 9BeautySecret (Wellness&Beauty) in Bataras Hypermarket in Kolombong, Inanam, near here.

The offence, under Section 13(a) of the Poisons Act and punishable under Section 32(2) of the same Act, carries a fine of up to RM3,000 or a jail term of up to a year, or both, upon conviction.

On the second count, he was ordered to pay a fine of RM2,000 or 14 days’ jail for having 25 unregistered products at the same place and time.

On the third count, Ivan was fined another RM2,000 or two weeks’ jail for having for sale seven cosmetic without labels at the same place and time.

During mitigation, Ivan who was not represented, asked for leniency saying that he did not know that the products contained poisons and not registered with the Ministry of Health (MOH) as well as no notifications on the cosmetics.

Ivan informed the court that he just got a new job as a consultant and that he has no intention to risk the public’s health.

However, Prosecuting Officer Oong Chi San from the Pharmacy Department urged the court to impose an appropriate sentence as Ivan had committed the offences which could risk the public’s health.

Oong said the products contained poison and not registered with the MOH.
