
Kota Kinabalu: A 19-year-old man was fined RM5,000 or 36 months jail by the Traffic Court, Thursday, for careless and inconsiderate driving which resulted in an accident, last year.
Lewin Ng pleaded guilty before Magistrate Jessica Ombou Kakayun to committing the offence while driving a Kia Rio car along Jalan Bundusan, near the Pavilion roundabout, Penampang, at 2.10am on Dec 26, 2021.
The court was informed by the prosecution that Ng, who was heading towards Kapayan from Beverly Hill, lost control of his car when he reached the area and the vehicle went into the opposite lane and collided with a Proton Wira coming from the other direction.
The driver of the Proton Wira and its passenger were injured and received further treatment at the Queen Elizabeth Hospital 2, said the prosecution.
Unrepresented, Ng requested leniency by saying among others that he was still studying.
Traffic prosecuting officer Inspector Mohammad Khairul Nizam Mokhtar applied for an adequate sentence.
Ng was charged under Section 43(1) of the Road Transport Act 1987 (Amended 1999) which carries a fine of between RM4,000 and RM10,000 and liable to jail of up to 12 months, on conviction.
In another case, two men were jailed a day and fined RM10,000 or six months jail for drink driving.
Henrey Walter, 53, and William Neys, 39, admitted to committing the offence at 8.30pm on Jan 31 this year at Jalan Tuaran bypass, Kg Rampayan, and at 11.35pm on May 30, last year at Jalan Penampang-Kota Kinabalu, in front of the SMK Bahang Penampang, respectively.
The court also ordered their respective driving licences to be suspended for two years.
They were charged under Section 45A(1) of the Road Transport Act 1987 provides for a fine of between RM1,000 and RM6,000 or jail of up to 12 months, on conviction.
Meanwhile, a 25-year-old man was charged with two counts of threatening to kill his father and injuring his stepsister.
Jobless Abdul Habir pleaded not guilty to the charges.
On the first count, he was accused of threatening to kill Mujibburahman Sadik and to burn his house at 10am on July 23, this year at the Warung Rampaian Inanam.
On the second count, Habir allegedly caused hurt to Marshiela Md Ibrahim at 5pm on the same day in front of a house at Kg Kalansanan, Inanam.
The first count under Section 506 of the Penal Code carries a jail term of up to two years or fine or both on conviction, while the second count under Section 323 of the Penal Code carries a jail term of up to one year or a fine or both, on conviction.
The court set Aug 30 for case management of both cases.
