
Kota Kinabalu: A 39-year-old man was jailed 35 months on Tuesday on three counts of offences including car theft.
Kou Tze Wang was handed 20 months’ jail by Magistrate Stephanie Sherron Abbie after he pleaded guilty to stealing a Proton Wira Aeroback belonging to one Wong Yuk Yun at 10.30am on Feb 3, this year at a house at Taman Nosoob, Jalan 7km, Penampang.
The offence, under Section 379A of the Penal Code, carries a jail term of between one year and seven years and liability of a fine on conviction. The court ordered Kou to serve the sentence from the date of his arrest on March 3 this year.
On the second count, Kou was jailed eight months by Magistrate Lovely Natasha Charles after he admitted to disposing of stolen properties namely three units of air conditioner compressor, two stainless steel and some copper iron at 12 noon on Feb 26, this year at scrap metal premises, Kinagain Sdn Bhd Kg Langkuas, Kinarut.
The offence, under Section 414 of the Penal Code, carries a jail term of up to seven years or fine on conviction.
The court heard from the prosecution that Kou was arrested behind a restaurant at Putatan on March 8 this year by police, who also seized several items which were reported stolen from a restaurant in Bundusan, Penampang, on March 2.
Lovely ordered the jail term to run from the date of Kou’s date of arrest.
Meanwhile, Kou on the third count was sentenced to seven months’ jail after he admitted to taking syabu on March 7, 2020.
He committed an offence under Section 15(1) of the Dangerous Drugs Act which provides for a fine of up to RM5,000 or up to two years’ jail on conviction.
The court ordered him to serve the sentence consecutively with the other jail terms.
Earlier, Kou, who was represented by duty counsel Lim Ming Zoong @ Lawrence, requested a lenient sentence and the sentence to be run from the date of his arrest, as he has five children. The prosecution applied for an adequate sentence.
In the same court, a 26-year-old Filipino was jailed seven months for having a unit of stolen Huawei MatePad tablet.
Al Kahizel Lokman admitted to having the stolen item belonging to one Lahirul Latigu at 8.30am on Jan 21 this year in a rented house at Kg Delima, Manggatal. The court heard from the prosecution that the tablet was among properties reported stolen from a house at Alamesra on Jan 17 this year.
Kahizel, who admitted to having no identity card, told the court that he was asked by one Marjin to sell the tablet.
Kahizel was charged under Section 411 of the Penal Code which carries a jail term of up to five years or fine or both on conviction.
The court ordered Kahizel to be referred to the Immigration Department after serving his sentence. Inspectors Kelvan Elson Maik and Suzie @ Stephanie Kupit prosecuted.
