
Kota Kinabalu: A 24-year-old gravedigger who bought a stolen handphone for RM150 was sent to prison for 10 months on Friday.
Md Syahzairul Syahmirzi pleaded guilty before Magistrate Stephanie Sherron Abbie to keeping the stolen Vivo Y66 handphone belonging to Pavana Borneo Spa at 1.20am on April 19, at a petrol kiosk in Kg Air.
Syahzairal had committed an offence under Section 411 of the Penal Code which carries a jail term of up to five years or a fine, or both, on conviction.
Earlier, the court was informed by the prosecution that the gadget was among properties reported stolen from the said spa on April 3.
Duty counsel Lim Ming Zoong @ Lawrence representing Syahzairul requested a lenient sentence from the date of his arrest by saying that the handphone had been returned to its owner and that he bought the stolen gadget for RM150 only.
Stephanie ordered Syahzairal to serve the sentence from the date of his arrest.
Meanwhile, a lorry driver claimed trial for stealing vehicle batteries.
Md Akbar Asri Rais was accused of stealing two units of Hitachi batteries from a lorry belonging to TCF Transport company, at 12noon on May 1, at a construction site next to Hyundai East KKIP, Sepanggar.
The charge under Section 379A of the Penal Code carries a jail term of between one year and seven years and a fine on conviction.
The prosecution, in applying for case management, proposed bail at RM5,000 in two sureties.
Duty counsel Lim representing Akbar applied for a lower bail sum on the grounds that he works as a lorry driver.
Magistrate Lovely Natasha Charles fixed June 24 for case management and offered Akbar bail at RM1,500 in two sureties.
