
Kota Kinabalu: A couple was jailed five months each by the Magistrate Court, Friday, for having and disposing of stolen items.
Azaharin Abdul Razak, 28, pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali for various types of cards, handbag and spectacles belonging to a complainant at 4am on Jan 3 in Kampung Wak-Wak, Sepanggar.
He was charged under Section 411 of the Penal Code, which carries a jail term of between six months and five years and liability of fine, on conviction.
Azahari’s wife, Dalimah Kaman, 25, pleaded guilty to disposing of necklaces, earrings and pendants belonging to the complainant at 5pm on Jan 3 at Taman Indah Permai, Sepanggar.

Deputy Public Prosecutor (DPP) Ling Ghuong Zin told the court that the complainant and friend found their valuables stolen on Dec 31 at Borneo Beach Villa in Karambunai.
Azahari was arrested after a report was lodged and police found a knife and items belonging to the complainant. He was also tested positive for drugs.
Investigations also found Dalimah assisting her husband in disposing of the stolen items by pawning the jewellery using her identity card.
Duty Counsel Lim Ming Zhoong, representing Azahari and Dalimah, requested a lenient sentence as both of them couldn’t afford a fine and Dalimah is two months pregnant.
DPP Ling applied for an appropriate sentence.
In another case, a 36-year-old man was jailed four months for theft.
Shahrul Nizam Abdul Rasyid pleaded guilty to stealing two Nike jackets, basketball shorts, two Nike shorts, Adidas jacket and bag at 1.10pm on Nov 19, 2023, at D’ Bundle Mania ITCC, Penampang.
He was charged under Section 380 of the Penal Code which carries a jail term of up to 10 years and liability of a fine, on conviction.
DPP Ling told the court that the complainant saw Shahrul and his accomplice changing their clothes, stuffing items and leaving the store without paying.
Police arrested Shahrul and his accomplice later the same day.
Duty Counsel Lim, representing Shahrul, requested leniency as he has two children and is the sole breadwinner of the family. DPP Ling applied for an appropriate sentence.
The court ordered Shahrul to serve the sentence from the date of his arrest.
In another court, a 28-year-old Indian national was fined RM10,000 or three months jail for drunk driving.
Mac Carls Daniel Mathews pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence at 2am on May 14, 2023, at Jalan Kota Kinabalu-Penampang, in front of SMK Bahang.
Mac was charged under Section 45A(1) of the Road Transport Act 1987 (Amendment) which provides for a jail term of up to two years and fined of between RM10,000 and RM30,000, if convicted.
Unrepresented, Mac requested leniency as he has to take care of his family.
