Duo jailed for cash drawer theft

Kota Kinabalu: Two men were sentenced to 10 months’ jail by the Magistrate’s Court here on Friday for disposing of a stolen cash register drawer belonging to a restaurant.

Jamrey Jamil, 33, and AhmadHardy Norbin, 26, pleaded guilty before Magistrate Dzul Elmy Yunus to disposing of a stolen cash register drawer, belonging to Grill Patio Asia City restaurant here, on Sept 14, 2pm, at the roadside of Kg Numbak, Manggatal.

They were charged under Section 414 read with Section 34 of the Penal Code, which carries a maximum seven years’ jail, or a fine, or both, on conviction.

The court heard from the prosecution that the said item was reported stolen from the said premises, which was broken into on Aug 23, at 6.23am.

Jamrey and AhmadHardy, who were then arrested, admitted their involvement and led police to the stolen cash register drawer, which had been discarded by the roadside at Kg Numbak, Manggatal.

The drawer was identified by the complainant as belonging to the restaurant, with markings underneath supporting its ownership.

Duty counsel Jasamine Tan, representing both men, requested leniency, saying Jamrey worked as a wireman while AhmadHardy worked at a workshop.

The duo were ordered to serve their sentences from the date of arrest.

Meanwhile, Jamrey was sentenced to another six months’ jail for disposing of a stolen motorcycle.

He pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to committing the offence on Sept 14, at 2.30pm, at the roadside of Kg Suang Parai, Manggatal.

The offence is also framed under Section 414 of the Penal Code.

The court heard from the prosecution that the complainant had reported his Honda motorcycle missing after it was parked by the roadside at Simpang 3, Kg Delima, Manggatal, at about 6pm on July 11.

Acting on information, police, led by Jamrey, recovered the motorcycle at about 2.30pm on Sept 14, parked beside an abandoned house at Kg Suang Parai, Jalan Sulaman, Manggatal.

Duty counsel Carmen Khoo sought leniency, saying Jamrey was single and worked as a wireman.

The prosecution applied for a deterrent sentence.

Jamrey was ordered to serve the sentence from the date of his arrest.

In another case, two men were charged with stealing alcoholic drinks from their workplace.

Salman Abdullah, 22, and Jhosua Junaidi, 27, pleaded not guilty before Magistrate Dzul Elmy to jointly stealing four cartons of Labour 5 alcoholic drinks.

The offence was allegedly committed at about 3pm on Sept 22, at D’Borneo Distillery Sdn Bhd, KKIP Selatan, where both men worked.

They were charged under Section 381 read with Section 34 of the Penal Code, which carries a maximum seven years’ jail, a fine or whipping on conviction.

The court fixed Oct 29 for pre-trial case management and released the accused on a bail of RM1,800 in two sureties each.
