KOTA KINABALU: A 48-year-old man with two previous convictions for taking syabu, was sentenced to five years’ jail and ordered to get a stroke of the cane repeating a similar offence for the third time.
Sukiman Salimin, pleaded guilty before Sessions Court Judge Zaini Fishir, to the charge against him.
Sukiman took the dangerous drug also known as Amphetamine and Methamphetamine, on Aug 13 at 5.20pm after his urine was tested positive for drug at the Narcotics Criminal Investigation Division Office, District Police Headquarters here.
The charge stated that he has two previous convictions under Section 15(1)(a) of the Dangerous Drugs Act 1952.
His first conviction was recorded in 2024 at the Magistrate’s Court here where he was sentenced to seven months’ imprisonment and placed under police supervision for two years.
For his second conviction early this year, he was sentenced to five months’ imprisonment and placed under police supervision for two years.
Sukiman is now charged under Section 15(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 39C(1) of the same Act, read together with Section 38B(1) of the Act which carries imprisonment between five and seven years, and at least three strokes of the cane.
Section 38B(1) also provides for the accused to be placed under the supervision of an officer as provided under Section 2 of the Drug Dependants (Treatment and Rehabilitation) Act 1983 after serving sentence, for a period of not less than two years and not more than three years.
After completing the jail sentence, Sukiman was ordered placed under police supervision.
Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir appeared for the prosecution while Sukiman was unrepresented.
