Online gambling: Man fined RM1,100

Kota Kinabalu: The Magistrate’s Court on Tuesday fined a 32-year-old man RM1,100 or two months’ jail for engaging in online gambling activity.

Magistrate Lovely Natasha Charles meted out the sentence to Sharif Abdul Kadir after he admitted to online gambling with a handphone at 2.30pm on May 12 at premises in Kg Likas.

Inspector Kelvan Elson Maik, prosecuting, told the court that Sharif was arrested by police following information and that RM184 cash was also seized from him.

Unrepresented, Sharif applied for a fine and said he has no permanent job and has six dependents.

He was charged under Section 7(2) of the Common Gaming House Act which provides for a fine of up to RM5,000 or up to six months’ jail, or both, on conviction.

The court ordered the seized money to be forfeited by the government.

In another case, a 21-year-old man, who fraudulently had RM2,300 deposited into his bank account two years ago, was fined RM100 or two weeks’ jail.

Xavier Joe admitted to having the money in his bank account, which he failed to give a satisfactory explanation on how he obtained them on May 24, 2020.

He had committed an offence under Section 22A (1) of the Minor Offences Ordinance, which provides a fine of up to RM100 or up to three months jail or both on conviction.

Duty counsel Lim Ming Zoong @ Lawrence, representing Xavier, requested a fine and told the court that Xavier, who currently works in Penang as a restaurant kitchen helper, returned here to face the present charge.

The prosecution applied for an adequate sentence.
