RANAU: A 19-year-old worker was fined RM2,000 by the Ranau Magistrate’s Court after pleading guilty to voluntarily causing hurt to a man at a worksite in Kg Toupus here.
Calvin Charlz bin Nurdin was ordered to pay the fine, in default seven months in jail. He was charged under Section 323 of the Penal Code, which carries a maximum penalty of one year in jail, or a fine of up to RM2,000, or both.
The incident occurred at about 1pm on June 21, 2026, at the Pan Borneo construction site in Kg Toupus, here.
The victim, Shahizan bin Salleh, subsequently lodged a police report, claiming that he had been assaulted by the accused, who allegedly used a walkie-talkie during the incident.
Shahizan suffered injuries including swelling and bruising to his face, as well as injuries around his mouth and eye area.
Police investigations found that the incident occurred after Shahizan approached the accused and asked him not to sit or behave in a manner that could obstruct or endanger him near the side of a lorry.
The accused allegedly became angry and struck Shahizan, resulting in the injuries.
Following the report, the Ranau District Police Headquarters launched an investigation into the incident.
Acting on information received, a team from the Criminal Investigation Division of the Ranau District Police Headquarters conducted an operation on June 23, 2026.
The team, led by a senior police officer, located and detained the accused in front of a house in Kg Toupus.
During a body search, police found a black Baofeng walkie-talkie, which was seized as an exhibit.
The investigation papers were subsequently referred to the Sabah Deputy Public Prosecutor’s Office, resulting in the accused being charged under Section 323 of the Penal Code.
The court later imposed a RM2,000 fine, with seven months’ imprisonment in default of payment.
Section 323 of the Penal Code provides for imprisonment, a fine, or both upon conviction for voluntarily causing hurt.
The case serves as a reminder that physical violence arising from a minor confrontation may result in criminal charges.
