
Kota Kinabalu: A 37-year-old man was fined RM2,500 or nine months’ jail by the Magistrate Court, Tuesday, for assaulting his wife.
Johari Jikirani pleaded guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to his wife at 5pm on Nov 1, 2023 at Kampung Air.
He was charged under Section 323 of the Penal Code, read together with Section 326A of the same Code.
Section 323 carries a jail term of up to one year and a fine of up to RM2,000, or both, on conviction, while Section 326A states that whoever hurt to his spouse or former spouse, a child, disabled adult, or other family members and commits an offence under 323, 324, 325, 326, 334, or 335, shall be punished with imprisonment for a term of twice as long as the maximum term for which they would be liable upon conviction.

In the quarrel, Johari slapped and punched his wife, causing her to sustain minor injuries on her head, nose, lips and right wrist, Al Hakim said.
Counsel Michelle Osman, representing Johari, requested for a lenient sentence, while Al Hakim applied for a deterrent sentence.
In another case, two men were jailed 10 months for having drugs.
Mohd Shahrizan Musli, 37, and Al Khazir Darius, 30, pleaded guilty to having 0.04gm and 0.13gm of syabu, respectively, on Sept 30 and Sept 20, 2023, at 4.15pm and 3pm, at different locations in Menggatal and Likas.
They were charged under Section 12(2) of the Dangerous Drugs Act (ADB) 1952 which provides for a fine up to RM100,000 or up to five years’ jail on conviction.
Duty Counsel Lim Ming Zhoong, representing Shahrizan and Al Khazir, requested for a lenient sentence.
Al Hakim applied for a deterrent sentence for both Shahrizan and Al Khazir.
The court ordered them to serve the sentence from the date of arrest.
