Kota Kinabalu: A 51-year-old man was jailed six months by the Magistrate’s Court, here, Tuesday for failing to carry his identity card.
Thamrin Bakri pleaded guilty before Magistrate Marilyn Kelvin to committing the offence at about 1.30pm on Aug 22, at a premises along Jalan Kolopis, Penampang-Tambunan road, Penampang.
The offence under Regulation 25(1)(n) of the National Registration Regulations 1990, provides for a jail term of up to three years or a fine of up to RM20,000, or both, on conviction.
The court heard from the prosecution that police conducted a raid and inspection at the premises and found Thamrin unable to produce his identity card.
Further investigation found that he was not carrying any identification document when detained.
Thamrin was ordered to serve the sentence from the date of his arrest.
In another case, a 28-year-old driver was fined RM3,000 or jailed eight months for retaining stolen property.
Azhar Janib pleaded guilty to dishonestly having the a welding unit, two portable gas cylinders and a welding mask belonging to one Chong Heng Loong.
The offence was committed at about 8.10am on Feb 7, at a parking area in Kg Serigai, Jalan Ketiau-Tembovo, Putatan.
He was charged under Section 411 of the Penal Code, which carries up to five years’ imprisonment or a fine, on conviction.
The prosecution informed the court that the complainant discovered several tools and equipment missing from the boot of his vehicle at 7am, on Feb 4, outside his house in Penampang.
The stolen items included welding equipment, gas cylinders, drills, a wood cutter and welding masks, with the total loss estimated at RM4,000.
Police then arrested Azhar on Feb 7 and seized the items from a parking area, where the complainant later identified them as his property.
Duty counsel Lim Ming Zoong, representing Azhar, requested a lower fine, saying he is married with one child, works as a driver, is the sole breadwinner and supports his single mother and two younger siblings.
The prosecution applied for a deterrent sentence.
