Kota Kinabalu: A 28-year-old man was sentenced to 12 months’ jail by the Magistrate’s Court here for keeping a stolen car, while another man was fined RM1,400 for placing football bets.
Mohd Hafieszul Mohd Adnin pleaded guilty before Magistrate Marilyn Kelvin to keeping the stolen vehicle at about 8pm on Sept 19 this year at the Shell petrol station compound along Jalan Tuaran Bypass, Manggatal.
The offence, under Section 411 of the Penal Code, carries a jail term of between six months and five years, and a possible fine, upon conviction.
The court heard that police arrested Hafieszul while he was seated in the driver’s seat of a silver Proton Saga MC2 with its engine running. The car had been reported stolen.
He also handed over a set of keys and a remote control for the vehicle to the police.
In mitigation, duty counsel Lim Ming Zoong @ Lawrence said Hafieszul was married with one child and was remorseful.
However, the prosecution sought a deterrent sentence.
The court ordered the jail term to take effect from the date of his arrest.
Hafieszul had previously been jailed for six months by the same court on April 22 for keeping a stolen motorcycle.
In a separate case, a 35-year-old man was fined RM1,400, in default one month’s jail, by the same court for placing football bets.
Shah Rizal Sazry Induk pleaded guilty to the offence, which was committed at about 10pm on June 25 this year in front of The Myth, at Kota Kinabalu Towering Industry Centre, Penampang.
The offence, under Section 6(1) of the Betting Act 1953, carries a fine of up to RM5,000, imprisonment of up to six months, or both, upon conviction.
The court heard that police arrested Shah Rizal during a raid after finding him placing football bets.
An Oppo A5 mobile phone in silver, allegedly used in the betting activity, was seized as an exhibit. Prosecuting Officer Inspector Yusdi Basri conducted the prosecution.
